By accessing or using the OMNET IT System website (www.omnetit.in) or by engaging OMNET IT System for IT services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.
These terms apply to all visitors, clients, and users of our website and services.
2. About Our Services
OMNET IT System provides IT support, managed IT services, cybersecurity, computer repair, laptop repair, server management, network support, and IT AMC services to businesses across Delhi NCR. Our services are detailed on our website and in individual service agreements.
The information on this website is for general informational purposes. While we strive to keep it accurate and up to date, we make no guarantees regarding completeness, accuracy, or suitability for any particular purpose.
3. Service Agreements
Formal IT support and managed service engagements are governed by a separate written Service Level Agreement (SLA) or Statement of Work (SOW) agreed between OMNET IT System and the client. In the event of any conflict between these Terms of Service and a specific SLA/SOW, the SLA/SOW shall prevail.
Enquiries submitted via our website do not constitute a binding contract. A contract is formed only upon written confirmation of an agreed scope of work and pricing.
4. Intellectual Property
All content on this website — including text, graphics, logos, icons, and software — is the property of OMNET IT System or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
5. Limitations of Liability
OMNET IT System provides IT services on a best-efforts basis. While we maintain high service standards and response SLAs, we shall not be liable for:
- Indirect, consequential, or incidental losses arising from IT failures or service interruptions
- Data loss where adequate backup systems were not in place or were not managed by OMNET IT System
- Losses arising from cyber attacks, third-party software failures, or hardware failures beyond our control
- Decisions made by the client based on information or advice provided by OMNET IT System
Our total liability in any circumstance is limited to the fees paid by the client in the three months preceding the event giving rise to the claim.
6. Client Responsibilities
Clients engaging OMNET IT System agree to:
- Provide accurate information about their IT environment and requirements
- Grant necessary access to systems for support and maintenance
- Maintain adequate data backups unless backup management is explicitly included in the service agreement
- Pay invoices within the agreed payment terms
- Not use our services for any illegal or unauthorised purpose
7. Payment Terms
For managed IT contracts, invoices are issued monthly in advance. Payment is due within 15 days of the invoice date unless otherwise agreed in writing. Late payments may incur interest at 18% per annum. All prices are exclusive of GST (18%) unless otherwise stated.
8. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the business relationship. OMNET IT System will not disclose client system information, network details, or business data to third parties without express consent, except as required by law.
9. Termination
Either party may terminate a monthly managed IT service contract with 30 days written notice. Project-based contracts may only be terminated as specified in the relevant SOW. OMNET IT System reserves the right to suspend services immediately in the event of non-payment or breach of these terms.
10. Governing Law
These Terms of Service are governed by the laws of India. Any disputes arising from use of our website or services shall be subject to the exclusive jurisdiction of the courts in Gautam Buddha Nagar (Noida), Uttar Pradesh, India.
11. Changes to Terms
We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our website or services after changes constitutes acceptance of the new terms.
